This section deals with conditions relating to the sale of products directly by Europa Pet Foods Ltd. to you as a consumer – as a consumer, any order from you is subject to these terms and conditions.
These conditions do not apply to sale of Europa Pet Foods Ltd. products by one of our independent distributors. If you are one of our independent distributors, sales of products by Europa Pet Foods Ltd. to you as a distributor are covered by separate Terms & Conditions.
All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
Nothing in these terms and conditions shall affect the statutory rights of any consumer
When you place an order to purchase products direct from Europa Pet Foods Ltd., you are offering to purchase goods subject to these terms and conditions. Your order represents an offer to us to purchase a product – this offer is accepted by us only when we have take payment for the product from your payment card or dispatched that product to you. We may send you an e-mail confirming that we have received your order and which may contain the details of your order, however this email does not represent acceptance of your order, only confirmation that we have received your offer. In the event that we take payment for and ship only part of your order, only that part of your order that we have taken payment for or dispatched to you will form that contract.
By necessity we will rely on the information you have provided in your order to process it, take payment and deliver it, and you are therefore responsible for ensuring the accuracy of the details provided on the order form and we will not be obliged to accept an order unless all details requested on the order form have been entered correctly. In the event that the details provided are incorrect in any way, if you advise us within 24 hours we will endeavour to rectify these without charge. We reserve the right, however, to pass on any additional costs incurred from such errors or omissions.
Whilst in normal circumstances we are pleased to receive orders for our products, we do reserve the right to refuse any order placed with us and will not be required to provide an explanation.
The pictures of our products shown on our web site are provided for illustrative purposes only. Goods that we ship to you may differ from the images shown.
The technical literature out our products provided on our web site – and in particular the Typical Analyses - is also for illustrative purposes only. We take pride in the quality of our products, which will be within industry standard tolerances of the stated analyses.
The prices for direct sale to individual consumers for an order will be those shown on this web site at the date and time that the order is received and include both VAT and the cost of standard delivery to most of the mainland UK. Unless otherwise indicated, these prices are based upon delivery of 30Kg i.e. 2 x 15Kg bags of our product to you. Please note that the cost of delivery of our pet food to more distant parts of the UK can be higher than normal – and in these circumstances our prices may be different. If this is the case you are requested to contact us so that we may advise you about the change in price and allow you to decide whether you wish us to proceed with your order.
Whilst we will not normally increase the price of product between order and dispatch, we reserve the right, by giving notice to you at any time before delivery, to increase the price of the goods to reflect any increase in the cost to us which is due to any factor beyond our control (such as without limitation, any foreign exchange fluctuation, significant increase in the costs of labour, materials or other costs of manufacture). In the unlikely event of there being such an increase in the price of the goods we will contact you and you may cancel your order if you wish.
Please note that dispatch estimates are just that - they are not guaranteed dispatch times and should not be relied upon as such. As we process your order, we will inform you by e-mail if any products you order turn out to be unavailable.
Due to the regulations regarding export of food products outside the UK, Europa Pet Ltd. does not supply pet food direct to consumers except in the UK i.e. England, Wales, Scotland and Northern Ireland.
When we provide any goods to you under these terms and conditions, payment will be charged to the payment card account provided by you on the website order form. By placing an order, you, the buyer, consent to payment being charged to your payment card account as provided on the order form.
Note that by placing an order you warrant that all details provided on the order form for the purpose of purchasing the goods are correct, that the payment card you are using is your own and that there are sufficient funds and/or sufficient unused limit available to cover the cost of the goods.
The goods will be delivered to you, the buyer, at the address provided by you on the order form. Title to the goods will pass to you, the buyer, on payment in full of the price of the goods. The risk in the goods shall pass to you upon delivery at this address.
Any time or date for delivery by us is provided to you in good faith but is an estimate only and no liability will be accepted for any loss whatsoever suffered or caused through late delivery or non-delivery.
Please examine your good at the time they are delivered - any damaged or defective goods must be rejected at the time of delivery. If you believe that you have not received all the goods we have dispatched, you must accept the goods that have been delivered and notify us as soon as possible and in any case within 2 working days of delivery so that we have the opportunity to enquire with the delivery chain to find out what has happened. If you have received damaged or defective goods, or if you have had short delivery, then we will either provide goods not delivered or provide replacement for damaged or defective goods or refund the purchase price (if paid) of missing, damaged or defective goods at our option and our liability for short delivery, damaged or defective goods shall be strictly limited to this. If we have not been notified within this period then the goods will deem to have been delivered undamaged, without defect and in accordance with the dispatch.
Notwithstanding these contractual conditions, we are proud of the quality of our products and want you and your pet(s) to be happy with the products you have purchased from us. In the event of any dissatisfaction other than described above, please contact us and without prejudice to the contract we will see what we can do to put things right.
Whilst we believe that our dog food is suitable for most dogs, the decision to feed a dog with a Europa Pet Foods product is the responsibility of its owner. If you have any concerns, please feel free to contact us to discuss these.
Products are packed and labelled for the UK Market. Packaging, labelling and ingredient laws and regulations may vary for other countries and accordingly Europa Pet Foods Ltd. cannot accept any liability whatsoever arising from such products being sold in any other country.
The right to cancel the contract by giving notice under The Consumer Protection (Distance Selling) Regulations 2000 does not apply to any contract entered into through our direct order facility by virtue of the nature of the goods supplied which are liable to deteriorate within the meaning of Regulation 13 (c).
If there is any reason that you are unsatisfied with the goods you receive direct from us, please contact us using the methods described above, and we will do our best to rectify the situation to your satisfaction.
The quality of products is guaranteed up to the ‘Best Before’ date. The Company does not operate a ‘Sale or Return’ policy. Products will only be collected if there is a quality problem.
Europa Pet Foods Ltd. will be responsible for any losses you suffer directly as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed.
Any claims in respect of breach of contract or non-performance of any order shall be limited to the value of the goods to which the claim relates.
Europa Pet Foods Ltd. only contract with adults for direct supply of pet food.
When you visit our web site or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
